While he has not been officially arrested, as sufficient proof has not been gathered to incriminate him, he is under watch. However, if the prosecution cannot find sufficient evidence to nail him, he will be allowed complete freedom. One of the sanctuary rangers has been able to identify where he keeps his merchandise in Sagyo, but there isn't enough skilled manpower to investigate the place, hence their outsourcing the task to Konoha shinobi to acquire incriminatory evidence from there. While the mission is straightforward, chances are that the illegal merchandise is well-hidden, and therefore more effort than just searching may be required to find the contraband.
